01
Publisher, agreement, and eligibility
Public Beach Finder is developed, published, and operated by Peter Goodale, an individual developer. Goodale Studios is Peter Goodale’s publishing brand; it is not a separate company or legal entity.
By downloading, accessing, or using Public Beach Finder, you agree to these Terms of Use and the Privacy Policy with Peter Goodale. If you do not agree, do not use the service. You must be legally able to enter into these terms. A parent or guardian is responsible for a minor’s use.
Apple’s Standard End User License Agreement also applies to the iOS and iPadOS app. If these terms conflict with Apple’s mandatory terms, Apple’s terms control to the extent required.
02
What Public Beach Finder provides
Public Beach Finder organizes public beach records, directions, source links, access notes, local policies, amenities, tides, forecasts, alerts, ratings, and other planning information. Features and coverage may vary by beach, location, device, season, subscription status, and service availability.
The catalog focuses on documented public saltwater beach access in the United States. A listing does not promise that every portion of a shoreline is public, that every access point is open, or that parking, swimming, pets, or a particular activity is permitted.
03
Changing information, safety, and official authority
Beach hours, fees, parking, permits, lifeguards, dog seasons, water quality, weather, tides, wildlife restrictions, erosion, storm damage, and emergency closures can change without notice. Verification dates describe when a source was checked; they do not guarantee that a rule remains unchanged.
Before visiting, review the linked managing-agency source and current posted notices. Obey lifeguards, emergency personnel, law-enforcement officers, property boundaries, signs, flags, and closures. Never rely on the app as your only source for weather, marine, swimming, rescue, evacuation, or emergency decisions.
Tide predictions and forecasts are estimates supplied by third parties. Actual water levels and local conditions can differ because of wind, waves, currents, storms, geography, and other factors.
04
Ratings and correction submissions
You may submit a numeric rating or suggest a factual correction. You promise that your submission is honest, relevant, lawful, and does not contain personal information, confidential material, private access instructions, threats, harassment, advertising, malicious code, or content you lack the right to provide.
Peter Goodale may review, reject, remove, retain, summarize, or use a submission to operate and improve the catalog. Corrections do not change a listing until reviewed. Approved numeric scores may contribute to an aggregate rating. Submitting a correction grants Peter Goodale a nonexclusive, worldwide, royalty-free license to evaluate, reproduce, adapt, and use it for the service.
05
Purchases and subscriptions
Digital features offered inside the app are purchased through Apple’s In-App Purchase system. Prices, trial terms, billing period, and included benefits are shown before confirmation. Auto-renewable subscriptions continue until canceled through Apple. Cancel before renewal to avoid the next charge.
Apple manages payment, renewal, cancellation, Family Sharing where enabled, and refund requests under Apple’s policies. Removing the app does not cancel a subscription. If a paid feature becomes unavailable, remedies are limited to those required by applicable law and Apple’s policies.
06
Acceptable use
Do not misuse the service; probe or disrupt its security; scrape it in a way that burdens operations; evade access controls; submit automated or manipulated ratings; impersonate another person; use the app to trespass; or present catalog information as a legal determination of property rights.
Peter Goodale may limit or terminate access when reasonably necessary to protect users, sources, infrastructure, legal rights, or service integrity.
07
Ownership and third-party material
Public Beach Finder’s original software, interface, branding, arrangement, and written material belong to Peter Goodale or his licensors. Government records, maps, weather information, tide information, agency names, and linked third-party content remain subject to their respective sources, notices, and terms.
You may use the app for personal, noncommercial planning. These terms do not transfer ownership of the app or permit copying, resale, reverse engineering, or creation of a competing database from the service except where applicable law expressly permits it.
08
Availability, disclaimers, and liability
The service is provided “as is” and “as available.” To the fullest extent permitted by law, Peter Goodale disclaims implied warranties of merchantability, fitness for a particular purpose, accuracy, availability, noninfringement, and uninterrupted operation.
To the fullest extent permitted by law, Peter Goodale is not liable for indirect, incidental, special, consequential, or punitive damages; lost data or profits; travel costs; denied access; citations; property disputes; injuries; weather or ocean conditions; or decisions based on stale, incomplete, or third-party information. Nothing in these terms limits rights or liabilities that cannot legally be limited.
09
Changes, severability, and contact
Peter Goodale may update the service and these terms. Material changes will be posted with a revised date. If part of these terms is unenforceable, the remaining provisions continue to apply. Failure to enforce a provision is not a waiver.
